Terms & Conditions

Please read these terms carefully before booking any experience with Dumont Mountaineering. By making a booking you confirm that you have read, understood, and agreed to these terms.

1. Introduction

These Terms and Conditions govern all bookings made with Dumont Mountaineering ("we", "us", "our"). Dumont Mountaineering provides guided mountain days, navigation instruction, and one-to-one coaching services across Scotland's highlands and mountain terrain.

By completing a booking with Dumont Mountaineering, you ("the client") agree to be bound by these terms in full. If you do not accept these terms, you should not proceed with a booking.

2. Bookings & Payments

2.1 Making a Booking

All bookings are subject to availability and are not confirmed until a written confirmation has been issued by Dumont Mountaineering and a deposit has been received.

2.2 Deposit

A non-refundable deposit of 30% of the total fee is required to secure your booking. The remaining balance is due no later than 14 days prior to the date of your experience.

2.3 Late Payment

If full payment is not received by the due date, Dumont Mountaineering reserves the right to cancel the booking and retain the deposit.

2.4 Pricing

All prices are quoted in pounds sterling (GBP) and are inclusive of instructor fees, planning, and any equipment specified at the time of booking. Travel costs and accommodation are not included unless explicitly stated.

3. Cancellation Policy

3.1 Cancellation by the Client

All cancellations must be made in writing via email. The date of cancellation is the date the written notice is received.

3.2 Cancellation by Dumont Mountaineering

We reserve the right to cancel or postpone any experience due to severe weather conditions, unsafe terrain, or circumstances beyond our reasonable control. In such cases, a full refund will be issued or an alternative date offered at the client's preference.

Scotland's mountain environment is inherently unpredictable. Safety will always take precedence over any scheduled activity. Cancellations made on safety grounds are at the sole discretion of the lead instructor.

4. Health, Fitness & Medical Conditions

4.1 Disclosure

All clients must disclose any pre-existing medical conditions, injuries, physical limitations, or relevant health information prior to their experience. This information will be treated confidentially and used solely to ensure your safety in the mountains.

4.2 Fitness Levels

Clients are responsible for ensuring they are physically fit and capable of undertaking the activity booked. Our pre-booking consultation will help assess suitability, but the final responsibility lies with the client.

4.3 Right to Refuse

Dumont Mountaineering reserves the right to refuse participation or remove a client from an activity if, in the instructor's judgement, continuing would pose an unacceptable risk to the client or others. No refund will be issued in such circumstances.

5. Risk, Liability & Participation Agreement

5.1 Inherent Risk

Mountaineering, hillwalking, navigation, and all associated outdoor activities carry an inherent level of risk, including the risk of serious injury or death. By booking with Dumont Mountaineering, you acknowledge and accept these risks.

5.2 Limitation of Liability

Dumont Mountaineering and its instructors shall not be held liable for any loss, injury, damage, or death arising from participation in any activity, except where such loss or injury is caused by the proven negligence of Dumont Mountaineering.

5.3 Personal Belongings

Dumont Mountaineering accepts no responsibility for loss or damage to personal belongings, equipment, or vehicles during any experience.

5.4 Insurance

Clients are strongly advised to hold appropriate personal accident and mountain rescue insurance prior to participating in any experience. Dumont Mountaineering holds full public liability insurance.

6. Equipment & Clothing

Clients are required to arrive with appropriate clothing and equipment for the conditions. A kit list will be provided at the time of booking. Dumont Mountaineering reserves the right to refuse participation to any client who arrives without adequate clothing or equipment where this poses a safety risk.

Any specialist equipment loaned by Dumont Mountaineering remains the property of Dumont Mountaineering and must be returned in the condition it was provided. The client will be liable for the cost of repair or replacement of any loaned equipment that is damaged or lost.

7. Conduct & Instructor Authority

The lead instructor has absolute authority over all decisions made during an experience, including route choices, turnaround decisions, and whether to continue or abandon an activity. All clients are required to follow the instructions of the lead instructor at all times.

Any client behaving in a manner deemed unsafe, disruptive, or threatening may be removed from the activity immediately. No refund will be issued in such circumstances.

8. Photography & Media

Dumont Mountaineering may take photographs or video during experiences for use in marketing materials, social media, and the website. If you do not wish to be photographed, please inform your instructor before the start of the activity.

Clients grant Dumont Mountaineering a non-exclusive licence to use any photographs or video taken during their experience for promotional purposes.

9. Data Protection & Privacy

Dumont Mountaineering collects and processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Personal data is collected solely for the purpose of managing your booking and ensuring your safety.

Your data will not be shared with third parties without your consent, except where required by law or for the purposes of mountain rescue or emergency services.

You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us directly.

10. Mountain Rescue

Mountain Rescue in Scotland is a voluntary service provided free of charge to those in distress in the mountains. In the event of an emergency, your instructor will make the appropriate call to the emergency services. Clients are strongly encouraged to register with a mountain rescue scheme and carry appropriate personal insurance.

Dumont Mountaineering will cooperate fully with Mountain Rescue, Police Scotland, and any other emergency services in the event of an incident.

11. Amendments to Terms

Dumont Mountaineering reserves the right to amend these Terms and Conditions at any time. The most current version will always be available on this website. Bookings made prior to an amendment remain subject to the terms in effect at the time of booking.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Scotland. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Scottish courts.
